Clean Water Act Rules Hurt Transportation Sector’s Ability To Fix Nation’s Roads & Bridges, Construction and Materials Groups Tell U.S. Supreme Court

(WASHINGTON) — Confusing rules promulgated by federal agencies under the Clean Water Act (CWA) are hurting the transportation construction sector’s ability to deliver infrastructure improvements that benefit all Americans, according to an amicus brief filed April 13 with the U.S. Supreme Court by the American Road & Transportation Builders Association (ARTBA) and National Stone, Sand & Gravel Association (NSSGA).

As your committee understands well, federal infrastructure investment at all levels is critical for our nation’s economic recovery and water infrastructure projects are no different, especially those vital projects covered by the Army Corps of Engineers (Corps) chief reports via the Water Resources Development Act (WRDA) reauthorizations. Robust federal investment in water infrastructure would put tens of thousands of Americans back to work and improve the daily lives of millions of Americans regarding navigable waterway projects, shoreline protection, flood mitigation and so much more.

Thank you for your efforts to prioritize much-needed resources for our Clean Water State Revolving Fund (SRF), authorizing $40B over five years, that will dramatically improve our nation’s wastewater infrastructure network. We welcome the attention and resources afforded to states and municipalities regarding their local pollution control programs and attention on those projects of most need for sewer improvement.
