Impact of Chevron and Other Court Cases

Chevron USA, Inc. v. Natural Resources Defense Council, Inc. is one of the most important judicial decisions of the modern era, requiring federal courts to accept agencies’ reasonable interpretations of ambiguous statutes. This term, the Supreme Court heard a pair of cases in which the court decided to overrule the Chevron doctrine. The Court will also decide other cases likely to impact agency authority, including SEC v. Jarkesy and Corner Post, Inc. v. Board of Governors of the Federal Reserve System.

Bayer provided a brief overview of important planning considerations and then opened the discussion to questions from members.
